Nike Settles Lawsuit With The Shoe Surgeon Over Trademark Infringement

Nike is suing powerhouse sneaker customizer Shoe Surgeon. In a lawsuit filed today, it accused the Surgeon aka Dominic Ciambrone, of running an “illicit ‘Nike’ empire.”

Nike alleges that Ciambrone has been creating counterfeit “Nike” sneakers, selling them as officially branded products, and teaching others to do the same. The company claims that Ciambrone’s activities are illegal and deceive consumers.

Nike valued its relationship with Ciambrone and did not have any issues with the limited, one-of-one customization he has been doing for them or their clients. However, the company says that Ciambrone has begun to mass-produce counterfeit “Nike” sneakers, which are not authorized by Nike and do not meet the company’s high standards.

Nike is seeking a legal solution to address Ciambrone’s activities and to protect its brand and intellectual property. The company is also seeking to prevent Ciambrone from teaching others to create counterfeit “Nike” sneakers.

Nike is pursuing compensation for damages relating to over 30 of its trademarks, amounting to more than $60 million. They are also seeking the profits the defendant earned from counterfeiting, tripled, in addition to attorneys’ fees.

The Shoe Surgeon has not yet responded to the lawsuit.

Nike’s lawsuit against Ciambrone is a major development in the ongoing battle between the company and sneaker customizers. It remains to be seen how this case will be resolved.

In the meantime, consumers should be aware of the risks of buying counterfeit sneakers. Counterfeit sneakers may not be made with the same high-quality materials as authentic sneakers, and they may not be as durable. Additionally, counterfeit sneakers may not be covered by the same warranties as authentic sneakers.

If you are considering buying a pair of custom sneakers, it is important to do your research and make sure that you are buying from a reputable seller. You can also check with Nike to see if the customizer is authorized to sell Nike products.

Nike has a long history of protecting its brand and intellectual property. The company has sued other sneaker customizers in the past, and it is likely that it will continue to do so in the future.

The lawsuit against The Shoe Surgeon is a reminder that Nike is serious about protecting its brand and intellectual property. It is also a reminder that consumers need to be careful when buying custom sneakers.

UPDATE 6/19/25: Nike has officially settled its high-profile lawsuit with The Shoe Surgeon over unauthorized use of its Nike trademarks. The legal case, originally filed in 2024, ends with the customizer agreeing to pay Nike an undisclosed sum.

Under the terms, The Surgeon is banned from using any Nike branding that may confuse customers. However, he may continue creating 1-of-1 custom sneakers, but only under strict Nike-approved conditions.

This marks the end of a major legal battle in the world of sneaker customization and trademark enforcement.

UPDATE 7/19/24: Representatives from The Shoe Surgeon have contacted Sneaker Bar Detroit with an official statement regarding the lawsuit filed by Nike.

The Shoe Surgeon’s official statement below:

“It’s a dream to collaborate with legendary brands. Especially with the brand who tells us to believe in something. Who tells us it’s only crazy until we do it. Tells us the best is yet to come. Tells us to be better. To just do it.

We are confused Nike has chosen litigation over a discussion, but we are confident with proper dialogue and collaboration we can resolve this with the new management team and turn it into a win for the culture.

Creating defines us. Our pursuit of greatness is the soul of every creation and authenticity is stitched into our DNA.

Where there is unity, there is victory.“
